Order: Court denied motion filed by Reproductores


Overview
On April 19, 2024, the Eighth Civil Court of First Instance rejected a procedural motion filed by Reproductores Avícolas, S.A. seeking to challenge BDT Investments Inc.’s legal standing. The plaintiff argued that BDT had not proven ownership of Lisa, S.A.’s shares and therefore lacked capacity to claim rights linked to shareholder status, including the right to recover prescribed dividends. The motion asked the court to expand on its earlier ruling from February 13, 2024, which had reversed a prior decision.
The court dismissed the motion, holding that the February ruling had already addressed the plaintiff’s objections and that no legal omission existed that would justify an expansion. It concluded that the arguments raised by Reproductores Avícolas did not meet the criteria for a valid request under Articles 596 and 597 of the Civil Procedure Code. The motion was therefore denied in its entirety.
