Court Order: Revocation of precautionary measures by Agroprocesos

On December 6, 2016, the First Civil Court of Guatemala issued a resolution revoking the precautionary measures initially decreed on March 12, 2012, in the case filed by Agroprocesos Avícolas, S.A. against Lisa, S.A. The revocation was requested by Lisa, S.A., represented by Tito Enoc Marroquín Cabrera, arguing that the guarantee posted by the plaintiff—required to maintain such measures—had expired since October 2013 and had not been renewed.

Upon review, the court found the claim valid and ruled that the expiration of the bond nullified the basis for maintaining the precautionary measures. Consequently, the court ordered the immediate lifting of the measures specified in the original resolution. This decision emphasized adherence to procedural rules and the obligations of parties requesting judicial protections.
