Order: Court dismissed damages claim by Las Margaritas


Overview
On May 31, 2022, the Eighth Civil Court of First Instance dismissed a damages lawsuit filed by Avícola Las Margaritas, S.A. against Lisa, S.A. The plaintiff claimed Lisa had harmed its reputation and caused financial losses through abusive litigation and a broader campaign of defamation. However, the court upheld a peremptory exception, ruling that the claim lacked the necessary procedural prerequisites to proceed under Guatemalan civil law.
Specifically, the court found that the damages claim was premature, as it was contingent on Lisa’s exclusion from the corporate structure—a matter still in legal dispute at the time. As a result, the court concluded that the plaintiff had not met the conditions required to seek reparation and dismissed the lawsuit in full. Las Margaritas was ordered to pay the legal costs of the proceeding.
