Amparo Ruling: Supreme Court denied amparo filed by Forrajera

On August 2, 2018, the Supreme Court of Justice (Chamber of Amparo and Antejuicio) denied the amparo filed by Industria Forrajera de Mazatenango, S.A. against the First Civil Appeals Court. Forrajera had challenged an appellate ruling that upheld the dismissal of its damages lawsuit against Lisa, S.A., based on the finding that the original complaint was procedurally defective and filed in the wrong venue (ordinary rather than summary proceedings).

The Supreme Court ruled that the Appeals Court acted within its legal authority and did not violate Forrajera’s constitutional rights. It found no merit in Forrajera’s claim that the appellate decision was unappealable or that the lower court’s ordinary process was appropriate. The Court also imposed a fine on Forrajera’s attorney and ordered costs against the plaintiff.
