Cassation Ruling: Supreme Court rejected cassation by Administradora

On March 17, 2025, the Civil Chamber of the Supreme Court of Justice formally certified its decision rejecting the cassation appeal filed by Administradora de Restaurantes, S.A. against a prior appellate ruling that dismissed its lawsuit against Lisa, S.A. for procedural defects. The Court found the appeal inadmissible, ruling that the challenged decision was not subject to cassation because it did not resolve the merits of the case.
This resolution closes the case procedurally. Administradora’s claim that Lisa’s dividend obligation had prescribed was dismissed at every level—from the trial court through the Court of Appeals and ultimately the Supreme Court. All courts found that the original lawsuit lacked the required clarity and supporting documents. Lisa, S.A. has prevailed in full.
