On December 5, 2019, Guatemala’s Constitutional Court denied the amparo filed by Lisa, S.A. against the Civil Chamber of the Supreme Court of Justice (CSJ). The Court agreed with the CSJ that Lisa’s cassation was inadmissible because the appealed decision did not resolve the merits: the appellate court had sustained a “depurative” exception (lack of legal representation/personería) and therefore revoked the first-instance judgment that had favored Lisa’s opposition to shareholder exclusion. As such, there was no definitive ruling on the underlying controversy to enable cassation review.
