Order: Court dismissed damages claim by Avícola Villalobos

On July 4, 2023, the Thirteenth Civil Court of First Instance ruled against Avícola Villalobos, S.A., dismissing its claim for civil and moral damages allegedly caused by Lisa, S.A. Villalobos argued that Lisa's conduct, including public statements and litigation strategies, constituted a campaign to harm the company’s reputation and finances. However, the court found that the evidence presented did not meet the legal threshold to establish actual, quantifiable damage as required under Guatemalan civil law.
The court concluded that while some of the documents submitted might suggest Lisa’s involvement in adverse actions, they did not prove the required elements of causation or material loss. Only two pieces of evidence were granted probative value; the rest were disregarded either for lacking relevance or for addressing matters outside the scope of the damages proceeding. The court therefore declared the lawsuit unfounded and dismissed it in its entirety.
