Appeal Ruling: Court upheld dismissal of abuse claim by Alimentos para Animales

On June 22, 2023, the Fifth Chamber of the Court of Appeals for Civil and Commercial Matters ruled against Alimentos para Animales, S.A., rejecting its appeal and confirming the April 5, 2023 trial court decision. The lower court had dismissed the company's lawsuit against Lisa, S.A. for alleged abuse of rights and damages. The trial judge found that Alimentos para Animales was not named in the criminal complaint that allegedly caused the harm, and therefore had no standing or basis to claim injury.

The appellate court upheld this conclusion, noting that Lisa’s legal actions were not directed against Alimentos para Animales and no link between those actions and any actual harm was established. The court affirmed that no abuse of rights occurred and confirmed the dismissal of all claims. The ruling also maintained the order requiring Alimentos para Animales to pay court costs.
