On February 2, 2023, the Fifth Civil Court of the First Judicial Circuit formally took over the summary accounting action filed by Lisa, S.A. against Villamorey, S.A. The transfer occurred because Order No. 2119 of October 31, 2022 had declared proven the recusal incident filed by Villamorey’s representatives against Judge Solange Le Ferrec Malek de Booker of the Fourth Civil Court, resulting in her removal from the case. As a consequence, jurisdiction passed to the Fifth Civil Court pursuant to Article 159 of the Judicial Code.

The newly assigned judge ordered incorporation of the existing contempt incident and the recusal incident into the main case file, along with a correction of the page numbering beginning at page 240. The court’s decision ensures continuity of proceedings and allows the accounting case initiated by Lisa to continue under the authority of the Fifth Civil Court.
