Resolution 2186: Prosecutor admitted Lisa’s complaint against Bosch


Overview
On September 9, 2022, the Public Prosecutor’s Office of Panama issued Resolution No. 2186-22 in criminal case 202200053278. The resolution formally admits the criminal complaint filed by Lisa, S.A. against Juan Luis Bosch Gutiérrez, in his role as general agent and legal representative of Villamorey, S.A. The complaint alleges serious criminal conduct including fraud, falsification of documents, and economic crimes that resulted in at least $40 million in damages to Lisa, S.A., which holds 33.3% of Villamorey’s shares.
The Prosecutor acknowledged that Bosch retained control of multimillion-dollar dividend payments owed to Lisa and failed to report to the civil court as legally required. While noting that the case remains at an early stage, the resolution recognizes Lisa, S.A. as the legitimate complainant and victim and confirms that Bosch will be treated as the formally accused party. The complaint was declared admissible under Articles 79, 84, 88, 89, and 296 of Panama’s Criminal Procedure Code.
