Overview

On June 22, 2023, the Anti-Corruption Prosecutor’s Office issued Resolution No. 73-2023 formally admitting the criminal complaint filed by Lisa, S.A. against Juan Luis Bosch Gutiérrez for alleged offenses against public administration in the form of multiple modalities of fraud. The complaint alleges that Bosch, acting as Villamorey’s administrator, legal representative, and judicial depositary, diverted or retained more than $70 million in dividends owed to Lisa as a 33.3% shareholder, failed to account for judicially deposited funds, and concealed financial information.

The Prosecutor’s Office determined that Lisa’s complaint satisfied all procedural requirements under Article 88 of the Criminal Procedure Code. The resolution recognizes Lisa as the complainant, Bosch as the accused party, and accepts the evidence submitted—including court orders, correspondence, and corporate records. The Prosecutor’s Office will now investigate whether sufficient evidence exists to establish criminal liability for the alleged misappropriation and related conduct.
