Resolution 593: Rejected case closure and ordered further investigation


Overview
On November 14, 2023, the Anticorruption Prosecutor’s Office issued Resolution No. 593-2023, rejecting Juan Luis Bosch Gutiérrez’s request to archive criminal case No. 202300033850. Bosch’s defense argued that the dispute over withheld dividends was civil in nature and referenced unrelated archived cases. The prosecutor ruled that the alleged embezzlement—Bosch’s failure to return or report funds as judicial depositary—constitutes a public administration crime and falls under the exclusive authority of the Public Ministry. As the case remains in its preliminary stage, further evidence is required before determining criminal liability.
The resolution ordered additional investigative actions: a follow-up interview with court official Javier Castillero Anzola (scheduled for November 30, 2023) and inquiries to all Civil Circuit Courts about potential judicial measures against Lisa, S.A. as of April 14, 2015. The prosecutor denied Lisa’s request to summon Bosch for testimony, citing his right against self-incrimination under Articles 25 and 98 of the Criminal Procedure Code. All submissions from both parties were formally accepted into the record for future evaluation.
