Edict 249-24

On September 30, 2024, the Fourth Superior Tribunal of the First Judicial District confirmed Order No. 898 of April 12, 2022, issued by the Twelfth Civil Court, which approved the extrajudicial settlement submitted by BDT Investments Inc. and Lisa, S.A. in the simple enforcement proceeding. The appellate judges held that the lower court had correctly approved the transaction on the terms agreed by the parties and decided not to impose costs, in line with the reasoning set out in the body of the ruling.

By confirming Order No. 898, the Fourth Superior Tribunal left the approval of the settlement fully in force, giving final appellate backing to the liquidation and rights-assignment agreement reached between BDT Investments Inc. and Lisa, S.A. This confirmation consolidates the parties’ negotiated resolution of the enforcement dispute and provides greater legal certainty for the implementation of the agreed terms, without adding any adverse cost burden to either side.
