Superior Court: Superior Court confirmed BDT–Lisa settlement

On September 30, 2024, the Fourth Superior Court of the First Judicial District of Panama issued a resolution confirming Auto No. 898, originally issued on April 12, 2022, by the Twelfth Civil Court. The Superior Court upheld the approval of the extrajudicial settlement agreement between BDT Investments Inc. and Lisa, S.A., concluding the review of the simple enforcement proceeding initiated by BDT.

The court found no procedural or substantive error in the approval of the transaction, which had been voluntarily signed by both parties and complied with the relevant legal standards. The confirmation was issued without awarding legal costs, as noted in the reasoning section of the resolution. This ruling solidifies the legal standing of the 2020 agreement and brings the enforcement dispute closer to resolution.
