Motion: Rogatory letter requested to lift embargo in Guatemala

On February 3, 2024, attorneys for BDT Investments Inc. and Lisa, S.A. jointly filed a motion before the Twelfth Civil Court of Panama requesting the issuance of a rogatory letter. The purpose of the letter is to formally communicate the lifting of an embargo on shares held by Lisa, S.A. in various companies incorporated in the Republic of Guatemala. The embargo had originally been imposed in connection with the enforcement proceeding identified as Exp. 31638-12.

The request is based on Auto No. 898 dated April 12, 2022, which approved the settlement agreement between the parties and is now final and enforceable. Given that the embargo on Lisa’s shares has been lifted under that order, the parties seek the court’s assistance in notifying the competent Guatemalan authorities via international judicial cooperation.
