On May 28, 2025, BDT Investments Inc. filed a motion before the Twelfth Civil Court requesting the issuance of an international letter rogatory to Guatemalan judicial authorities. The request seeks to compel Villamorey, S.A. to provide a complete, detailed accounting of the administration, disposition, and current status of approximately $19,000,000.00 held or formerly held in accounts at GTC Bank in Guatemala. The motion identifies the need for certified bank records, full transaction histories, and confirmation of whether any funds have been released, to whom, and under what circumstances. BDT bases the request on Article 2(b) of the Inter-American Convention on Letters Rogatory, which allows cross-border evidence gathering.

The motion explains that this information is essential because Villamorey has controlled these funds for years and must account for their management now that the 2012 attachment has been formally lifted. The Twelfth Civil Court’s Order No. 898 (April 12, 2022) and subsequent notices—including the December 2022 and January 2025 communications to Villamorey—confirmed that no precautionary measures remain in force, eliminating any legal restriction on producing the required bank information. BDT therefore asks the court to admit the request and issue the international judicial communication to obtain the financial records needed to clarify the status of the $19 million.
