Motion: Court requested Villamorey to explain $19M at GTC Bank


Overview
On May 28, 2025, BDT Investments Inc., through its legal representative Carlos de Icaza, requested the Twelfth Civil Court of Panama to issue a rogatory letter to Guatemala. The aim is to compel Villamorey, S.A., or its legal representative, to report on the management, use, and current status of approximately $19 million allegedly held in accounts at GTC Bank in Guatemala. The motion is grounded in Article 2(b) of the Inter-American Convention on Letters Rogatory and refers to Auto No. 898 (April 12, 2022), which lifted a previous embargo imposed in Auto No. 1838. The court had already notified Villamorey of the lifted measure via Official Notices No. 3409 (December 12, 2022) and No. 28 (January 2025). BDT emphasizes that no precautionary order currently blocks this disclosure and argues the request is legally valid, necessary for trial, and supported by international judicial cooperation norms.
