Overview

On October 27, 2008, the Eleventh Civil Court issued Order 1624-08, formally decreeing a judicial seizure requested by Villamorey, S.A. against Lisa, S.A. after Villamorey posted the required bond to guarantee damages. The seizure was imposed up to $281,172.85, covering capital, costs, and provisional expenses. The order targeted Lisa, S.A.’s assets due to the ongoing dispute arising from the ordinary proceeding between the parties.

The seizure applied to Lisa, S.A.’s shares in multiple Guatemala-based Avícola companies—including Alimentos para Animales, Avícola Las Margaritas, Administradora de Restaurantes, Compañía Alimenticia de Centroamérica, Importadora de Alimentos de Guatemala, Industria Forrajera de Mazatenango, and Inversiones Empresariales—as well as Lisa’s 3,333 shares in Villamorey, S.A. It also covered all dividends declared in favor of Lisa, S.A. The Court ordered that the measure be communicated via rogatory letters so that each company would register the seizure and become judicial depositaries of the dividends pursuant to Article 536(4) of the Judicial Code.
