Motion: Lisa requested return of withheld dividends

On February 10, 2025, Lisa, S.A. submitted a formal motion to the Eleventh Civil Court of Panama requesting the return of dividends that were judicially seized in 2008 and held by Villamorey, S.A. and Juan Luis Bosch Gutiérrez as depositary. The motion states that the underlying litigation, Exp. 556-99, concluded with Auto No. 2277-2018, which authorized offsetting the $894,718 judgment owed to Villamorey using Lisa’s retained dividends. That amount has already been satisfied, and the embargo from a related case filed by BDT Investments Inc. was lifted on January 3, 2025.

Lisa now argues that there are no remaining legal grounds for the continued withholding of funds. The motion requests the Court to notify Juan Luis Bosch Gutiérrez, in his capacity as judicial depositary, that his role has concluded and he is legally obligated to render an accounting and return any remaining dividends or financial instruments. The funds have been under restraint for more than 16 years, since Bosch acknowledged on November 25, 2008 that the amounts were being held pending judicial instruction.
