Motion: Lisa accused Bosch of contempt for not returning funds

On February 11, 2025, Lisa, S.A. filed a motion before the Eleventh Civil Court of Panama requesting that Juan Luis Bosch Gutiérrez be declared in contempt for failing to return funds held under judicial deposit. Bosch had acknowledged in writing on November 25, 2008 (folio 2163 of the case file) that he was holding dividend funds owed to Lisa under a court-ordered seizure, yet he has never submitted an accounting or returned the funds despite repeated judicial developments.

Lisa argues that Bosch’s inaction violates Article 1932(8) of the Judicial Code, which defines contempt in civil matters as failing to return items entrusted by a judge, including money or documents. According to the motion, Bosch’s failure to comply with his obligations as court-appointed depositary constitutes an ongoing and unjustified refusal to return Lisa’s property, and the court is therefore asked to formally declare him in contempt.
