On February 11, 2025, Lisa, S.A. filed a motion before the Eleventh Civil Circuit Court in Expediente No. 556-99 requesting that Juan Luis Bosch Gutierrez be declared in contempt. The filing explains that Bosch was constituted as judicial depositary of dividends seized from Lisa, S.A. during the precautionary phase of the ordinary proceeding, as evidenced at page 2163 of the case file. Despite having placed the funds “at the Court’s disposal,” Bosch has never appeared, rendered an accounting, presented reports, or disclosed the status or location of the withheld dividends. Lisa, S.A. argues that this failure violates the obligations of a judicial depositary under the Judicial Code.

The motion invokes Article 1932(8) of the Judicial Code, which classifies as contempt any failure to return or deliver items held in judicial deposit when required by law or by court order. Lisa, S.A. stresses that Bosch’s prolonged refusal to account for or return the dividends constitutes a clear, unjustified breach of his legal duties and undermines the administration of justice. Accordingly, Lisa, S.A. asks the Court to formally declare Bosch in contempt and take the measures necessary to compel compliance and secure the return of the retained funds.
