Order 712: Court corrected Bosch’s deadline to render accounts


Overview
On April 11, 2023, the Sixteenth Civil Court of the First Judicial Circuit of Panama issued Order No. 712 correcting a procedural error in Auto No. 12 dated January 5, 2023. The original ruling had improperly stated that the defendant, Juan Luis Bosch Gutiérrez, was given five days to respond to Lisa, S.A.’s summary accounting demand. The court recognized this was inaccurate because, under Articles 1379 and 1380 of the Judicial Code, the purpose of the process is not merely to contest the claim but to appear and render a full accounting.
Exercising its corrective powers under Article 999 of the Judicial Code, the judge modified the language to reflect the appropriate deadline. Bosch is now granted ten (10) business days, from the date of notification, to appear before the court and render accounts as required by law. All other aspects of Auto No. 12 remain unchanged. This order ensures due process while advancing Lisa, S.A.’s efforts to obtain an accounting of $44.9 million in unpaid dividends.
