Letter Rogatory No. 29: Court requested Guatemala to notify Bosch

On July 19, 2023, the Sixteenth Civil Court of the First Judicial Circuit of Panama issued Letter Rogatory No. 29 requesting judicial assistance from the Republic of Guatemala to notify Juan Luis Bosch Gutiérrez of the pending summary accounting lawsuit filed by Lisa, S.A. The request was made under the Inter-American Convention on Letters Rogatory of 1975 and accompanied by Forms A, B, and C, as well as authenticated copies of the complaint, power of attorney, and judicial orders (Auto No. 12 and its correction, Auto No. 712).

The court seeks to notify Bosch, a Guatemalan national, at his business address in Guatemala City regarding his obligation to appear and render accounts for over $44.9 million in dividends withheld from Lisa, S.A. The request stresses that Bosch has failed to account for funds held as judicial depositary since 2010. If notification cannot be completed within four months, Panamanian law allows the plaintiff to seek substitute service through public edicts. This marks a key step in international cooperation to move forward with Lisa’s claim against Bosch.
