Letter Rogatory No. 29

On July 19, 2023, the Sixteenth Civil Court issued Official Notice No. 1635 and Letter Rogatory No. 29 requesting international assistance from Guatemala to notify Juan Luis Bosch Gutiérrez of the admitted Summary Accounting Demand filed by Lisa, S.A. The court transmitted authenticated copies of the power of attorney, the accounting demand, Order No. 12 (January 5, 2023), and its correction in Order No. 712 (April 11, 2023), directing Guatemalan authorities to complete service of process at Bosch’s business address in Guatemala City. The request cites the Inter-American Convention on Letters Rogatory and Article 1012 of the Panamanian Judicial Code.

The court summarizes that Bosch has held Lisa’s unpaid dividends for more than 13 years and has never provided an accounting of his management as judicial depositary. The notice instructs Guatemalan authorities to serve Bosch personally and return proof of service, or alternatively follow local procedures if personal service is not possible. If service is delayed beyond four months, the Panamanian court authorizes Lisa to request a substitute edict-based notification to continue the process.
