Order 966-2024

On April 12, 2024, the First Civil Circuit Court of the First Judicial Circuit of Panama issued Order No. 966/EJE-8853-24 in the ordinary action for indemnification of damages filed by Lisa, S.A. against Villamorey, S.A. The court found that the power of attorney and the complaint met the formal requirements of Articles 625, 628, 665 and 1265 of the Judicial Code, and therefore admitted the ordinary claim for damages and losses. It ordered that a copy of the complaint be served on Villamorey, S.A., represented by Ramiro López Nimatúj, granting the defendant ten (10) days to file its response, in accordance with the applicable procedural rules.

Once service of the complaint (or of any counterclaim, if filed) has been completed, the court declared that the case will automatically open to the evidentiary stage fifteen (15) days later, without the need for a further order, as provided by Article 1265 of the Judicial Code. This decision ensures that Lisa, S.A.’s damages action against Villamorey, S.A. will proceed on the merits, advancing the process towards the production of evidence and a future judgment on Villamorey’s alleged wrongful withholding of Lisa’s shareholder rights and related damages.
