Overview

On May 8, 2024, the First Civil Circuit Court issued Order No. 1217, correcting and expanding its earlier Order No. 966. The court determined that Lisa, S.A.’s ordinary damages complaint had been mistakenly admitted only against Villamorey, S.A., even though the claim was also filed against Juan Luis Bosch Gutiérrez in his personal capacity. Applying Article 999 of the Judicial Code, the court held that this type of omission is reformable at any time and therefore added Bosch as a personal defendant.

With this correction, the court ordered that Bosch be formally served and granted ten days to respond to the complaint. All other aspects of the April 12 admission order remain in force. The decision strengthens Lisa’s position by ensuring the case proceeds against both Villamorey, S.A. and Bosch personally, reflecting the company’s argument that both are responsible for the alleged damages.
