Counterevidence Brief: Lisa refuted standing and procedural objections

On December 6, 2024, Lisa, S.A. submitted a counterevidence brief in response to claims made by Villamorey, S.A. and Juan Luis Bosch Gutiérrez in their answer to the damages lawsuit. The defense alleged procedural misconduct and questioned Lisa’s legal standing. Lisa responded with documentary proof—including authenticated powers of attorney, failed notification records, and appeals—to show that its conduct followed court orders and that it remains a legal shareholder of Villamorey, S.A.

Lisa also requested that the court subpoena Villamorey and its legal agent Galindo, Arias & López (GALA) to produce shareholder meeting invitations and the official share registry to confirm that Lisa still holds 33.33% of Villamorey’s equity. Lisa emphasized that it has continued to receive shareholder notices, contradicting claims that it no longer has legal standing. It also requested recognition of key documents by Ramiro López Nimatuj and a certified copy of a disputed settlement from another court.
