Objections

On December 12, 2024, Lisa, S.A. submitted formal objections to the evidence introduced by Villamorey, S.A. and Juan Luis Bosch Gutiérrez. Lisa challenges the defendants’ documentary submissions, beginning with the authenticated request for a letter rogatory, arguing that the document has been presented in a misleading and incomplete manner. Lisa emphasizes that the request was made in strict compliance with an order issued by the Eleventh Civil Court and was not a voluntary act by Lisa, as defendants imply. Lisa also objects to the alleged “settlement agreement” between BDT Investments Inc. and Lisa, arguing that the document does not meet the admissibility requirements of Article 857 of the Judicial Code and bears no relevance to the issues in dispute. Finally, Lisa challenges the defendants’ reliance on Auto No. 1827-2020, stating that it concerns unrelated procedural matters.

Lisa also objects to the defendants’ evidence submitted during the evidentiary period, specifically their request for the court to obtain an authenticated copy of the alleged BDT–Lisa settlement. According to Lisa, defendants are attempting to introduce selective, incomplete, and irrelevant material to undermine Lisa’s claims and distract from the core issue: Villamorey’s longstanding withholding of Lisa’s dividends and refusal to recognize its shareholder rights. The objections seek to prevent defendants from expanding the evidentiary record with documents that do not meet procedural standards and have no probative value in the damages action.
