Objections: Lisa challenged Villamorey’s documentary evidence

Overview
On December 12, 2024, Lisa, S.A., through its attorney María Luisa Villarreal Palacios, submitted formal objections to several pieces of evidence filed by Villamorey, S.A. and Juan Luis Bosch Gutiérrez in the ordinary damages proceeding. Lisa challenged three key documents: (1) a request for international notification, arguing it was ordered by a prior court and not a voluntary act; (2) a purported settlement agreement with BDT Investments Inc., which allegedly fails to meet evidentiary standards under Article 857 of the Judicial Code; and (3) a 2020 court ruling presented as relevant but unrelated to the current case.
Lisa also objected to a new evidentiary request by the defendants seeking authenticated copies of the settlement agreement from another court. Lisa argued the document is irrelevant to the claim for damages and improperly presented. The brief reinforces Lisa’s position that the defense has submitted incomplete, misleading, and inadmissible materials in an attempt to derail or confuse the core claims regarding withheld dividends and shareholder rights.
