Abuse-of-Right Suits

From 2021 four companies sued Lisa for abuse of right under the Judiciary Act and the Civil Code, three of them in this record, over its amparos, its criminal complaints and its civil actions abroad; the largest pleaded some twenty years of such actions across Guatemala, Panama and the United States. Lisa's position is that these were the recourse of a shareholder unpaid since 1999 and that the suits seek to punish it for going to court. The lead suit was dismissed in February 2024, the court holding that Lisa's amparos were an exercise of its rights and showed no bad faith, and that no damage had been shown; the Supreme Court dismissed the company's cassation in July 2025. A second failed because the criminal complaint it rested on had not been directed at the company. The third, over a 2013 complaint, has passed Lisa's preliminary defenses and is undecided.
