Procedural Context

BDT's application came at an advanced stage of the summary accounting proceeding (Exp. 83573-21). After multiple attempts at international service of process in Guatemala, publication of edicts, and Bosch's failure to appear, the court appointed an absent-defendant attorney on August 9, 2024 (Order). BDT's intervention as assignee of Lisa's litigation rights sought to ensure representation of the substantive interest in the accounting for more than $44.9 million in dividends retained under judicial deposit since 2008.
