Procedural Abuse Allegations in Response to Legitimate Claims
Summary
Since 2021, several companies from the Avícola Villalobos Group—including Avícola Las Margaritas, Avícola Villalobos, and Alimentos para Animales—have filed lawsuits against Lisa, S.A. alleging abuse of rights. These claims accuse Lisa of misusing legal mechanisms such as criminal complaints and amparo actions to cause harm without justification.
Guatemalan courts have dismissed most of these cases. In lawsuits filed by Alimentos para Animales and Avícola Las Margaritas, the courts found no evidence of actual harm or any direct connection between Lisa’s actions and the plaintiffs. The rulings confirmed that Lisa was acting within its legal rights, and the claims were rejected, with court costs imposed on the plaintiffs.
In the case brought by Avícola Villalobos, the trial court allowed the case to proceed, holding that Lisa’s objections should be resolved during the main trial rather than in preliminary motions. The appeals court upheld this ruling but acknowledged that Lisa has the full right to defend itself and challenge the claim on its merits during the proceedings.
Together, these lawsuits reflect a pattern of attempts by the Avícola companies to discredit Lisa’s legitimate use of legal avenues. So far, Lisa has prevailed in all concluded cases and continues to defend its actions in the remaining litigation.
