Dismissed Criminal Complaint Filed by Villamorey Against a Civil Judge
Criminal Complaint No. 202200067006 was filed by attorney Moisés Bartlett Quiel—acting for Villamorey’s representative, Ramiro López Nimatúj—against Judge Solange Le Ferrec Malek de Booker of the Fourth Civil Court. The complaint alleged “abuse of authority” and other public-administration offenses, claiming the judge improperly issued Embargo Order No. 1234/14606-21 in favor of Lisa, S.A. without ruling on Villamorey’s prior objections.
After conducting interviews, obtaining authenticated copies of the civil-case record, and reviewing internal judicial procedures, the Anticorruption Prosecutor found no evidence of criminal conduct. The investigation revealed that the alleged “reclamation” by Villamorey had been embedded within a broader filing, causing a clerical omission later corrected through Order No. 1473/14606-21. That corrective order was consistent with Article 1129 of the Judicial Code and demonstrated that the judge acted within her legal authority.
The Prosecutor concluded that none of the elements of abuse of authority were met: there was no arbitrary act, no intentional misconduct (dolo), and no harm caused through an unlawful exercise of public power. As a result, Resolution No. 546-23 ordered the archival and dismissal of the complaint pursuant to Article 275 of the Criminal Procedure Code, stating that the facts did not constitute a crime and that the judge’s actions were legally justified. The complaint was formally closed.
