May 2025 Update — BDT Takes Legal Action on All Fronts

In May, BDT and Lisa, S.A. intensified their legal campaign to enforce judicial orders and expose misconduct delaying justice. A renewed restitution demand, appeals to higher courts, and a groundbreaking criminal complaint have significantly shifted the landscape.

Demanding Restitution of Retained Dividends

Lisa, S.A. formally reiterated its request to the Eleventh Civil Court for the return of dividends held since 2008 by Juan Luis Bosch Gutiérrez and Villamorey, S.A. Despite clear court orders—especially Auto No. 2277-2018—and the lifting of all embargoes as of January 2025, Villamorey continues to withhold the funds under false pretenses.

Lisa's attorneys provided authenticated evidence that Villamorey still falsely lists these dividends as “seized” in its shareholder records, highlighting a willful disregard of legal obligations.

Holding the Judiciary Accountable

In a bold move, Lisa, S.A. filed a criminal complaint against former Eleventh Civil Judge Lesbia Wolfschon Puga for abuse of authority and obstruction of justice. Despite being legally obligated to proceed with an execution process against Villamorey, Judge Wolfschon paralyzed the case for over two years. Lisa accuses her of intentional, arbitrary inaction, which violated due process and inflicted severe harm.

The complaint invokes articles 355 and 356 of Panama’s Penal Code and could become a landmark case in judicial accountability.

Appeals Accepted in Key Restitution Case

In a parallel effort, Lisa, S.A. and BDT successfully appealed Judgment No. 71 from January 2025 in the ongoing restitution case against Juan Luis Bosch. On April 7, the court granted both appeals and referred the case to the First Superior Court, ensuring the challenge moves forward under higher judicial scrutiny.

Guatemalan Court Recognizes Lisa’s Ownership and Embargo Lift

A final key development came from Guatemala, where the Eighth Civil Court of Guatemala City issued an official ruling stating:

Lisa, S.A. remains a registered shareholder of Avícola Las Margaritas.

Embargo measures on Lisa’s dividends were lifted in 2018 and 2022.

Any dividends owed after those dates cannot be withheld.

This directly undermines Villamorey’s claim that the funds are still legally frozen.
