Provisional Dismissal No. 362: Prosecutor closed forgery case against Lisa, S.A.

On September 30, 2024, the Public Ministry of Panama issued Provisional Dismissal No. 362, closing the criminal case No. 202200076373 regarding an accusation of document forgery against Lisa, S.A. The case was initiated by a complaint filed by Moisés Joel Bartlett Quiel, acting on behalf of Villamorey, S.A., alleging that a sworn statement submitted by Lisa, S.A.’s representative falsely claimed ignorance of Villamorey’s legal representative's whereabouts. The statement was part of a 2022 procedural filing in a civil enforcement case involving over $51 million.

The Prosecutor concluded that although the alleged facts might suggest a false declaration under Article 366 of the Penal Code, there was insufficient evidence of a criminal act. Lisa, S.A. had submitted all notifications and procedural actions using addresses known to both parties. No falsification or intentional deceit could be proven. As such, the complaint did not meet the legal threshold for prosecution, and the case was closed under Article 275 of the Criminal Procedure Code.
