Anti-Corruption Prosecutor requests authenticated copies of Lisa, S.A. v. Villamorey, S.A. civil case file

In this official notice dated May 26, 2023, Assistant Anti-Corruption Prosecutor Lcda. Mirelly Diaz requested the Eleventh Circuit Civil Court Judge, Lcda. María Leticia Cedeño Suira, to transmit authenticated copies of the full case file from the ordinary proceeding with sequestration action filed by Lisa, S.A. against Villamorey, S.A. The request supports the criminal investigation for alleged embezzlement (Case No. 202300033850), initiated following a complaint filed by attorney Carlos De Icaza Muñoz.
The notice expressly invokes Article 75 of the Criminal Procedure Code, which requires public and private entities to provide prompt, effective, and complete cooperation with requests from the Public Prosecutor's Office:
"Las entidades públicas y privadas están obligadas a proporcionar la colaboración pronta, eficaz y completa a los requerimientos que formulen los agentes del Ministerio Público en cumplimiento de sus funciones, bajo apercibimiento de incurrir en las responsabilidades previstas en la ley." (Page 1)
This notice represents the second request from the Prosecutor's Office to the Eleventh Civil Court in this investigation. Days earlier, the Official Notice No. 2954 dated May 10, 2023 had requested detailed information about the status of the civil proceeding, Juan Luis Bosch Gutierrez's appointment as judicial depositary, his compliance with reporting obligations, and copies of key filings. The present notice supplements that earlier request by specifically requiring the complete case file in authenticated copies, providing the Prosecutor's Office with the documentary foundation needed to support the criminal investigation.
Less than a month after this notice was issued, the Prosecutor's Office entered Resolution No. 73-2023 dated June 22, 2023, formally admitting the criminal complaint against Bosch Gutierrez and recognizing Lisa, S.A. as the complainant party.
