The notice expressly invokes Article 75 of the Criminal Procedure Code, which obligates public and private entities to provide prompt, effective, and complete cooperation with requests from the Public Prosecutor's Office, under warning of the liabilities the law imposes for non-compliance:
"Las entidades públicas y privadas están obligadas a proporcionar la colaboración pronta, eficaz y completa a los requerimientos que formulen los agentes del Ministerio Público en cumplimiento de sus funciones, bajo apercibimiento de incurrir en las responsabilidades previstas en la ley." (Page 1)
On that authority, Assistant Anti-Corruption Prosecutor Lcda. Mirelly Diaz required the Eleventh Circuit Civil Court judge, Lcda. María Leticia Cedeño Suira, to transmit authenticated copies of the complete file of the ordinary proceeding with sequestration action filed by Lisa, S.A. against Villamorey, S.A., securing the documentary foundation for the embezzlement investigation docketed as <law id="pty-202300033850" />, opened on the complaint of attorney Carlos De Icaza Muñoz.
This notice is the Prosecutor's Office's second request to the Eleventh Civil Court in the investigation. Days earlier, <doc id="pty-202300033850-2023-05-10-a" />, issued on May 10, 2023, had sought detailed information on the status of the civil proceeding, Juan Luis Bosch Gutierrez's appointment as judicial depositary, his compliance with reporting obligations, and copies of key filings. The present notice supplements that request by demanding the complete case file in authenticated copies.
Less than a month later, the Prosecutor's Office entered <doc id="pty-202300033850-2023-06-22-a" />, dated June 22, 2023, formally admitting the criminal complaint against Bosch Gutierrez and recognizing Lisa, S.A. as the complainant party.
