Through Official Notice No. 5866, dated August 23, 2024, Deputy Prosecutor Mileyka Espinosa Vargas of the Anti-Corruption Prosecutor's Office formally requested Villamorey, S.A. to confirm whether it maintains financial reports for 2019 through 2024 and, if so, to provide authenticated copies. The request was issued as part of the criminal investigation into alleged offenses against economic patrimony in case No. 202300033850, initiated by Lisa, S.A.'s complaint against Juan Luis Bosch Gutierrez.
This notice directly implements the prosecutorial resolution of July 3, 2024, which granted Lisa, S.A.'s petition to compel Villamorey, S.A. and its registered agent, Galindo, Arias y López (GALA), to produce accounting records for 2019 through 2024. That resolution denied the subsidiary request for an on-site inspection, finding it duplicative of the written demand. The requested financial information is central to the investigation: Lisa, S.A. maintains that Bosch Gutierrez, acting as judicial depositary, improperly retained dividends owed to Lisa as a shareholder in Villamorey.
The notice cites Article 25 of the Constitution, which enshrines the privilege against self-incrimination, framing the constitutional context under which the demand is made. One month after issuance, the clarifying brief of September 23, 2024 specified Villamorey's and Bosch's address to ensure effective delivery of the notice.
