Court admits BDT Investment as interested third party in summary accounting proceeding against Bosch

By Order No. 18 of January 10, 2025, the Substitute Judge of the 16th Civil Circuit Court of the First Judicial Circuit of Panama admitted BDT Investment Inc. as an interested third party (litisconsorte) in the summary accounting proceeding brought by Lisa, S.A. against Juan Luis Bosch Gutiérrez. The court found that BDT had satisfied the procedural requirements for joining the litigation.
BDT's application came at an advanced stage of the proceeding. After multiple attempts at international service of process in Guatemala, publication of edicts, and Bosch's failure to appear, the court had appointed an absent-defendant attorney by order of August 9, 2024. BDT's intervention as assignee of Lisa's litigation rights sought to ensure representation of the substantive interest in the accounting for more than $44.9 million in dividends retained under judicial deposit since 2008.
