This motion, filed by Lisa, S.A. through its legal representative, Lcda. María Luisa Villarreal Palacios, seeks court authorization to contact two Panamanian institutions in order to track the status of the letter rogatory sent to Guatemala for service of process on defendant Juan Luis Bosch Gutiérrez.

Procedural Context

By January 2024, the accounting proceeding had spent months attempting personal service on Bosch in Guatemala. The court had issued a letter rogatory in July 2023 requesting service in Guatemalan territory, and in October 2023 the diplomatic dispatch authorization enabled transmittal of the documentation through the Ministry of Foreign Affairs. However, after several months, there was no confirmation of which Guatemalan judicial authority had received the request or what progress had been made on the notification.

Content of the Motion

Lisa requested that the Sixteenth Circuit Civil Court issue an authorization addressed to two entities: (1) the Office of International Legal Affairs of the Supreme Court of Justice of Panama, and (2) the Ministry of Foreign Affairs of the Republic of Panama. The authorization would allow Lisa, as an interested party, to obtain precise information regarding the location and identity of the Guatemalan judicial authority that received the letter rogatory.
