Court corrects admission order, sets ten-day deadline for Bosch to render accounts

16th Civil Court
Order No. 712 exercises the corrective authority under Article 999 of the Judicial Code to remedy an omission in Order No. 12 of January 5, 2023, which admitted the summary accounting complaint filed by Lisa, S.A. against Juan Luis Bosch Gutierrez but failed to set the deadline for the defendant to appear and render an accounting, the central purpose of the proceeding.
The original admission order directed service of the complaint with a five-day period to respond, a procedure appropriate for ordinary proceedings. The correction replaces that provision with one reflecting the special nature of the summary accounting process: Bosch is granted ten (10) business days from notification to appear before the court and render a full accounting in accordance with the parameters set forth in the complaint. The court grounds the correction in the complaint's compliance with Article 665 of the Judicial Code and with Articles 1379 and 1380, which specifically govern accounting proceedings.
"En atención a la naturaleza y extensión de esta obligación, SE CONCEDE UN TÉRMINO DE DIEZ (10) DÍAS HÁBILES, para que el demandado JUAN LUIS BOSCH GUTIERREZ, se presente a los estrado del Tribunal, a fin de que el mismo rinda cuenta por los parámetros antes señalados" (Page 1)
