The authorization follows <doc id="pty-83573-21-2023-07-19-a" />, issued on July 19, 2023, through which the Sixteenth Circuit Civil Court requested Guatemalan authorities to serve Juan Luis Bosch Gutiérrez with Order No. 12 of January 5, 2023 (as corrected by Order No. 712 of April 11, 2023) admitting the accounting demand in the Summary Accounting Proceeding (<law id="pty-83573-21" />). By releasing the documentation to María Luisa Villarreal Palacios, counsel for Lisa, S.A., the court allowed Lisa to handle the diplomatic dispatch directly through Panama's Ministry of Foreign Affairs, expediting a process that would otherwise have depended entirely on institutional channels.
The form specifies a diplomatic dispatch method, pursuant to the 1975 Inter-American Convention on Letters Rogatory and Article 1012 of Panama's Judicial Code. The dispatch was carried out at the requesting party's expense, in accordance with Note A.J.-MIRE-2021-53357 of July 21, 2021, and Note DAJI/0752 of August 4, 2021, which established the procedure for private parties to retrieve documentation from the Ministry of Foreign Affairs.
Despite these efforts, international service did not succeed promptly. Months later, Lisa was compelled to file a <doc id="pty-83573-21-2024-01-10-a" /> seeking authorization to obtain information on the location and identity of the Guatemalan authority that received the rogatory letter, underscoring the logistical difficulties that prolonged the attempt to locate and serve Bosch in Guatemala.
